1. Acceptance of Terms

By accessing or using the website located at bodyshopspa.info (the "Site") or any services provided by The Body Shop Spa ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after any changes constitutes acceptance of the revised Terms.

2. Description of Services

The Body Shop Spa is a wellness spa operating locations in Hutchinson, Wichita, and Derby, Kansas. We offer services including UV tanning, red light therapy, infrared sauna, PEMF therapy, oxygen therapy, body composition scanning, lymphatic compression, and related wellness programs. We also offer memberships, free educational guides, and wellness coaching.

Our Site provides information about our services, allows you to book appointments, sign up for memberships, and access educational content. We also use our Site to communicate with members and prospects via email and SMS.

3. Membership Terms

Enrollment and Billing

Membership enrollments are processed through Square, a PCI-DSS compliant payment platform. By enrolling, you authorize us to charge your payment method on a recurring monthly basis on your selected billing date (the 1st or 15th of each month). Your first charge is prorated from your enrollment date to your first billing date, plus a one-time signup fee where applicable.

Freeze Policy

Members may freeze their membership for a reduced monthly fee of $5.00 for up to five consecutive months. After five months of frozen status, the membership will be automatically cancelled. Freeze requests must be submitted through the member portal or by contacting us directly.

Cancellation Policy

Members may cancel at any time. Cancellations take effect at the end of the current paid billing period. You retain full access to your membership benefits through the end of your paid period. Signup fees are non-refundable. Only one membership change (cancel, freeze, or plan modification) is permitted per billing cycle.

Failed Payments

If a payment fails, we will attempt to notify you via email or SMS. Continued failure to resolve a failed payment may result in suspension or cancellation of your membership. You are responsible for keeping your payment information current.

4. Use of the Site

You agree to use the Site only for lawful purposes and in a manner that does not:

• Violate any applicable federal, state, or local laws or regulations
• Infringe upon the intellectual property rights of The Body Shop Spa or any third party
• Transmit any harmful, offensive, or disruptive content
• Attempt to gain unauthorized access to any portion of the Site or its related systems
• Scrape, crawl, or harvest data from the Site without our express written permission
• Interfere with the proper functioning of the Site

5. Social Media and Third-Party Platforms

We maintain official accounts on TikTok, Meta (Facebook and Instagram), LinkedIn, and YouTube. We use authorized developer APIs provided by these platforms to schedule and publish content on behalf of our business. Our use of these APIs is governed by each platform's respective developer terms of service and community guidelines.

When you interact with our content on social media platforms, those interactions are subject to the platform's own terms of service and privacy policies, which are independent of ours. We are not responsible for the policies or practices of any third-party platform.

6. Email and SMS Communications

By providing your email address or phone number, you consent to receive communications from us. Marketing emails and SMS messages are sent only to individuals who have opted in. You may opt out of marketing communications at any time by clicking "unsubscribe" in any email, replying STOP to any SMS, or contacting us at info@bodyshopspa.info.

Transactional messages — including membership confirmations, billing notices, and account updates — may be sent regardless of marketing opt-out status, as they are necessary for the administration of your account.
